HC guidelines for accident claim awards

Why is it in news?
  • The Rajasthan High Court has laid downs guidelines for Motor Accident Claims Tribunals in the State.
What are guidelines?
  • It is  to ensure that the awards passed in favour of the victims and claimants genuinely reach them and do not fall into the hands of unscrupulous elements.
  • The Court said that the Claims Tribunals would take on record the bank account details of all the claimants and ensure that all details of tax deduction and addition of new claimants were available.
  • After an award is passed the Claims Tribunals will direct the insurance companies or transport corporations to deposit the awarded amount in the bank account by online transaction, according to the guidelines.
  • The bank will receive the deposited sum and furnish a statement of account on a daily basis to the Registry of the Claims Tribunal.
  • The Court said the Claims Tribunals would keep tab on the deposits made and correlate them with the awards on the basis of the letters received from insurance companies.
  • The Claims Tribunals will ensure that the details of bank account are incorporated in the award itself, for compliance by those required to satisfy the award.
  • The tribunals would also ensure that the same procedure was followed in case of compromise recorded in the Lok Adalat proceedings.
