After SC rap, EC ‘wakes up to its powers’

Why in news?
  • Election Commission of India (ECI) has quickly changed its tack to pass a flurry of restraining orders against leading political candidates for their communally provocative and divisive speeches.
  • Poll body acted against communal speeches after top court pulled it up and gave it 24 hours to act.
Some laws that can be used against the hate speeches
  • Indian penal code 1860:
    (1) Section 124A that penalizes sedition.
    (2) Section 153A that penalizes promotion of enmity between different groups on grounds of religion, race, place of birth etc.
  • Representation of peoples act 1951:
    (1) Section 123(3A) and Section 125 that prohibits promotion of enmity on the ground of religion race, caste, community etc. in connection with corrupt election practices.
  • Cable television networks (regulation) act 1995:
    (1) Section 5&6 prohibits transmission of programme through cable network in contravention to the prescribed programme
    (2) code.
  • Cinematograph act 1952:
    (1) Section 4, 5B & 7 empower the board of film certification to prohibit and regulate the screening of the film
