Lockdown is Reasonable

Why in news?
  • The Supreme Court approved government’s statistics on death, terror and violence in J n K from 1990 as formidable reasons for the August 5, 2019 lockdown.
  • The lock down followed withdrawal of the special rights and privileges of Kashmiri people with the reading down of Article 370.

(1) Attorney-General justified the restrictions in the valley based on these figures.
(2) He told that since 1990, 41,866 persons had lost their lives in 71,038 terror incidents. They included 14,038 civilians, 5,292 security personnel and 22,536 terrorists.
  • Further more Solicitor General told the SC bench that no bullets have been fired after August 5.
  • The court directed the Union of India and the Jammu and Kashmir government to file their responses to petitions.
  • What are the petitioners concerns
(1) Public transport is not functioning.
(2) Media freedom is crippled.
(3) No internet and communication services.
(4) Difficulty in accessing the J&K High Court.
(5) As per media reports of detention of children aged between 10 and 18.
  • The Court has urged the J&K government to
(1) To take all the necessary measures keeping in mind national and internal security, to ensure that normal life is restored in Kashmir.
(2) Ensure people have access to healthcare facilities and schools, colleges and other educational institutions and public transport function and operate normally.
(3) CJI stated that he would seek a report from the Chief Justice of High Court and if the need be visit personally to the Union Territory of J n K over the allegation that the High Court is not approachable.
