- Supreme Court sought response of Election Commission of India (EC) on a petition challenging its decision to hold separate bypolls for two Rajya Sabha seats in Gujarat

- The petition filled by Gujarat Congress on the issue had earlier appeared before the Delhi High Court in 2009 in Satyapal Malik vs Election Commission of India case.
- In its verdict the Court held it was not mandatory to hold joint election in the case of casual vacancies.
- The EC’s also mentioned in its note that byelections to all Houses, including the Rajya Sabha, are considered separate vacancies. Separate notifications are issued and separate poll is taken for each of the vacancies.
- The question whether such vacancy is ‘casual’ or statutory needed to be decided,
- A similar order was issued by EC, pertaining to two casual vacancies from Uttar Pradesh, this has been quoted by the EC in its press note for bypolls to fill six casual vacancies in the Rajya Sabha from Bihar, Gujarat and Odisha.
