Draft Information Technology [Intermediaries Guidelines (Amendment)] Rules, 2018 in an advanced stage

Why in news?
  • The Centreinformed the Madras High Court that deliberations on the Draft Information Technology [Intermediaries Guidelines (Amendment)] Rules, 2018 had been completed.
  • These rule mandate social media companies to cooperate with the police in cracking cybercrimes.

  • Earlier an advocate had approached the Madras High Courtfor linking Aadhaar with social media accounts so that those who indulge in abuses and criminal activities could be identified easily and punished.
  • HC stated that
(1) It was not in favour of linking aadhaar with social media accounts.
(2) The Courtsuomotu impleaded Facebook, Google, YouTube, Twitter, WhatsApp as parties to the case so that they could be made to cooperate with the police in cracking cyber crimes by sharing information.
(3) The social media giants were bound to obey local laws and share information with the police.
(4) Companies could not take umbrage under the right to privacy as even fundamental rights are subject to reasonable restrictions.
