- About AFT:
(1) AFT has been set up in 2009, under Armed Forces Tribunal Act, 2007.
(2) It provides for the adjudication or trial of disputes and complaints with respect to commission, appointments, enrolment and conditions of service in respect of persons subject to the Army Act, 1950, the Navy Act, 1957 and the Air Force Act, 1950.
(3) It’s a quasi-judicial body.
(4) Armed Forces Tribunal has its Principal Bench at New Delhi and ten Regional Benches at Jaipur, Chandigarh, Lucknow, Guwahati, Kolkata, Chennai, Kochi, Jabalpur, Srinagar and Mumbai.
- Composition
(1) The AFT contains one Chairperson and Judicial and Administrative members. The number of both is decided by government.
(2) The person holding the office of chairperson of AFT must be either a retired judge of Supreme Court or retired chief justice of High court.
- Appointment
(1) The Chairperson and other Members of the Tribunal shall be appointed by the President, after consultation with the Chief Justice of India.
- Jurisdiction
(1) The territorial jurisdiction of AFT covers entire country and covers the three armed forces of India viz. Army, Navy and Air Force. Paramilitary forces don’t come under its jurisdiction.
(2) The AFT hears appeal against any order, decision, finding and sentence passed by Court Martial and related matters.
(3) Appeals against the decision of the AFT can be taken only in Supreme Court.
